General Terms and Conditions
for the SPOLUM Drum online shop
Effective from 12. 7. 2026
1. Seller and scope of these terms
The seller and operator of the online shop is Alexandr Jerechinský, Business ID (IČO): 14124661, with registered office at Litoměřická 834/19d, Prosek, 190 00 Praha 9, Czech Republic, an entrepreneur registered in the Czech Trade Licensing Register (the “Seller”). The Seller is not registered for VAT.
The online shop's trading name, brand and logo are SPOLUM Drum. This name does not change the Seller's identity. The Seller purchases and resells goods; the Seller is not the manufacturer unless expressly stated otherwise for a particular product.
Contact email: [email protected], telephone: +420 731 511 998. Main warehouse, address for returns and complaints: Neveklovice 44, 294 13 Neveklovice, Czech Republic. This is not a regularly open shop; visits or collection are possible only by prior arrangement.
These terms govern purchases of goods through the online shop between the Seller and a consumer. Consumer protection provisions apply to a buyer acting in the course of business only to the extent provided by law.
2. Information about goods and prices
The description, main characteristics, availability and final price are stated for each product. Photographs are illustrative if the product expressly states that individual items may differ, for example in pattern, shade or hand finishing.
All prices are final. The Seller is not registered for VAT and therefore does not itemise VAT on documents. Shipping costs, any surcharge for the selected payment method and the total amount are shown to the Buyer in the basket before a binding order is submitted.
A promotional price applies for the period stated in the offer or while stocks last. An obvious error in price or description that a reasonable customer must have recognised does not bind the Seller; the Seller will contact the customer without delay and offer to proceed on the correct terms or cancel the order.
3. Order and conclusion of the contract
The Buyer adds goods to the basket, selects shipping and payment, enters the requested details and can review and correct all entries before submission. The Buyer submits the order using a button that clearly indicates an obligation to pay.
The purchase contract is concluded when confirmation of receipt of the order is delivered to the Buyer's email address, unless the confirmation expressly states that further acceptance by the Seller is required. Together with the confirmation, the Buyer receives these terms in a form that can be stored and displayed repeatedly.
The contract is concluded in Czech. The Seller stores electronic order data for the period necessary to perform the contract and meet legal obligations; customers may access it through their account or on request.
4. Payment
Currently available payment methods are shown at checkout. They may include online card payment through a payment gateway, bank or QR payment and cash on delivery. The particular method may depend on the country of delivery, carrier and order value.
For online payment, the Buyer enters sensitive payment information directly into the payment service provider's secure interface. The Seller does not store payment card details. For payment in advance, the order will be dispatched after the full amount has been credited, unless stated otherwise.
Any fee associated with the selected payment method is always shown before the order is submitted.
5. Shipping, restrictions and receipt
We deliver goods only to countries and areas that can be selected at checkout. Available carriers, estimated delivery times and the final shipping price are calculated according to the address and the shipment's dimensions and weight and shown before the order is submitted. If a carrier does not serve the area or legal or transport restrictions apply, the order cannot be completed or the Seller will propose another solution.
Shipments outside the European Union may incur import duties, taxes or administrative fees that are not included in the online shop's price and are paid by the recipient, unless checkout expressly states otherwise.
The Buyer takes delivery of the shipment and checks that the packaging is intact. It is advisable to record visible damage with the carrier and notify the Seller as soon as possible; this does not affect statutory rights relating to defective performance. The risk of damage passes to the consumer on receipt of the goods or when they are handed to a carrier designated by the consumer that was not offered by the Seller.
6. Consumer withdrawal within 14 days
A consumer may withdraw from the contract without giving a reason within 14 days of receiving the goods; for multiple items delivered separately, the period begins on receipt of the last item or part of the delivery. It is sufficient for the consumer to send the Seller an unambiguous notice on the final day of the period, for example by email or using the model form on the Returns and Complaints page.
The consumer must send or hand over the goods no later than 14 days after withdrawal to Neveklovice 44, 294 13 Neveklovice. The consumer bears the direct return costs. Do not send the shipment cash on delivery; personal handover is possible only by prior arrangement.
The Seller will refund the money received, including the cost of the least expensive standard delivery method offered, within 14 days of withdrawal, using the same payment method unless the parties agree otherwise. The Seller may withhold the refund until the goods are received or proof of dispatch is provided. The consumer is liable only for diminished value caused by handling beyond what is necessary to establish the nature and characteristics of the goods.
The right of withdrawal does not apply in particular to goods made or modified to the consumer's wishes or personalised for them, or to other cases set out in § 1837 of the Czech Civil Code. An exception applies only if its statutory requirements are met and the customer was informed of it before ordering.
7. Rights relating to defects and complaints
The Seller is responsible to the consumer for ensuring that, on receipt, the goods are free of defects, match the agreed description, type, quantity, quality and functionality, and are suitable for their usual and agreed purpose. A claim may be made for a defect if it becomes apparent within two years of receipt. If a defect becomes apparent within one year, the goods are presumed to have been defective on receipt unless the contrary is proved.
A complaint may be submitted by email, post or in person by prior arrangement. Send the goods concerned to Neveklovice 44, 294 13 Neveklovice. Include the order number, a description of the defect, the remedy requested and contact details. The Seller issues written confirmation of receipt of the complaint and its resolution.
Subject to statutory conditions, the consumer may request that a defect be remedied by repair or delivery of a new item. If this is impossible or disproportionate, the consumer may request an appropriate price reduction or withdraw from the contract, particularly if the Seller refuses to remedy the defect, the defect recurs or there is a substantial breach of contract. The complaint, including remedying the defect, will be resolved and the consumer informed within 30 days at the latest, unless the parties agree on a longer period.
8. Personal data protection
Personal data processing is governed by the separate Privacy Policy available from the online shop's footer. The selected payment service provider also processes payment data to the extent necessary, and the relevant carrier processes delivery data.
9. Out-of-court dispute resolution
The competent body for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority, Štěpánská 796/44, 110 00 Praha 1, adr.coi.cz. Consumers may first contact the Seller at [email protected]. This does not affect the right to bring proceedings in court.
10. Final provisions
Legal relationships are governed by the law of the Czech Republic, in particular the Czech Civil Code and Consumer Protection Act. This choice of law does not deprive consumers of the protection afforded by mandatory provisions of the country of their habitual residence.
These terms apply to orders concluded from 12. 7. 2026. Earlier orders are governed by the terms and Seller stated in the confirmation of the relevant order. The Seller may change these terms for future orders; contracts already concluded are unaffected.
